A1.General Use

The content of the pages of this website is for your general information and use only. It is subject to change without notice.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. We exclude liability for any inaccuracies or errors to the fullest extent permitted by law. Your use of any information or materials on this website is entirely at your own risk.

Colours displayed may not reflect the true colour of items; if colour is a major factor, contact us before purchase.

We may change these Terms at any time by posting the amended version on this website; continued use is deemed acceptance. We may terminate your access to this website at our sole discretion at any time without notice, with no liability to you.

B.SUPPLY OF GOODS AND SERVICES

These supply terms apply in conjunction with our Refund & Returns Policy. Full commercial terms are set out in our Terms and Conditions of Trade, which form part of this agreement.

B1.Formation and Acceptance

By placing an order or accepting delivery of Goods, you unconditionally accept and are bound by these Terms. We are not obliged to supply Goods until a contract for supply is formed. Quotations are estimates only, are exclusive of GST, and remain valid for 30 days unless withdrawn earlier.

B2.Price and Payment

The price is as agreed in writing or per our prevailing price list at the time of your order. Unless you hold a credit facility with us that is not in default, Goods must be paid for before despatch. GST (currently 15%) is payable in addition to the price unless otherwise stated. Payment may be made by EFT, online banking, or credit card; a surcharge of up to 3.5% may apply to card payments. Our GST number is 134 680 814.

B3.Delivery and Risk

We will use reasonable endeavours to deliver at the agreed time and place. Any delivery timeframe is an estimate only and is not of the essence. Risk in the Goods passes to you on delivery or collection, and you must insure the Goods from that time.

B4.Retention of Title

Title in the Goods does not pass to you until you have paid in full and met all other obligations to us. Until then, you hold the Goods as bailee, must store them identifiably as our property, and we may recover possession if you default. Our interest constitutes a purchase money security interest under the Personal Property Securities Act 1999 (NZ).

B5.Returns, Damaged or Defective Goods

Our returns policy is set out in our Refund & Returns Policy. We do not accept returns for change of mind, except where required by the Consumer Guarantees Act 1993 or where due to our negligence or incorrect information supplied by us. Unless otherwise required by law, faulty product will, as a first option, be replaced by the same or an equivalent product.

INSTALLATION REQUIREMENT

All Goods sold must be installed by a suitably qualified and registered electrician. Warranties offered may be voided if Goods are not installed by a registered electrician in accordance with all applicable regulations and manufacturer instructions.

B6.Back Orders

Where Goods are unavailable from our suppliers and would need to be placed on back order, we will first offer you the choice of an equivalent product, a refund, or placement on a supply-when-available list.

C.CONSUMER RIGHTS AND GOVERNING LAW

FOR NEW ZEALAND CUSTOMERS

Nothing in these Terms excludes or limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you are acquiring Goods for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply to that supply, to the extent permitted by section 43 of that Act.

These Terms are governed by the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the New Zealand courts. The supply of Goods is subject to the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Personal Property Securities Act 1999 (NZ).
